Rental Agreement

1. Who this agreement is between

This agreement is between you (the person who books) and Totes NKY, a trade name of Yard Guard LLC, a Kentucky limited liability company ("we" or "us").

2. What you're renting

You're renting the plastic moving totes, lids, tote dollies, and any hand trucks listed on your booking (together, the "Equipment"). We deliver the Equipment to your drop-off address and collect it from your pickup address. We are a rental company, not a moving company. We don't pack, load, or move your belongings.

3. Rental period

Your rental runs from your delivery date to your pickup date, as shown on your booking confirmation. Every package includes 2 weeks. You can add weeks when you book, or text or call us before your pickup date to extend. Extensions are billed to your card on file at the weekly rate for your package.

4. Delivery, placement, and stairs

• We deliver and pick up starting at 9 AM on the scheduled dates and will text you a time window.
• You don't need to be home. We'll leave the Equipment at the spot you chose when booking (for example, the porch, garage, or driveway). Once it's delivered there, it's your responsibility.
• If we need to carry Equipment up or down stairs, a stairs fee applies to that visit: $10 for the first floor and $5 for each additional floor. If stairs are needed but weren't included in your booking, we may charge the stairs fee to your card on file.

5. Payment and your card on file

You pay the full booking amount, including any delivery fee, stairs fee, and sales tax, when you book. Payments are processed by Stripe; we never see or store your full card number. By booking, you authorize us to save your payment method with Stripe and charge it later for (a) extra weeks you request, (b) stairs fees not included at booking, and (c) the fees in sections 7 through 9. We'll let you know before charging any fee.

6. Taking care of the Equipment

• Use it for packing, moving, and storing ordinary household goods.
• Don't put hazardous materials, chemicals, fuel, liquids, food waste, or anything illegal in the totes.
• Label totes only with the dry erase markers, label pockets, and cards we provide. No permanent markers, paint, stickers, tape, or other permanent markings, and don't alter the Equipment. Permanent markings count as damage under section 7.
• Keep loads to what one person can safely lift and stack. Don't overload dollies or stack totes so high they may fall.
• Keep the Equipment reasonably secure. You're responsible for it from delivery until we pick it up.

7. Lost, broken, or very dirty Equipment

Normal wear is expected and free. If Equipment is missing, broken, or too dirty to clean with normal washing, you agree to pay:

We count Equipment at pickup and inspect it afterward. If something is missing or damaged, we'll contact you with what we found before charging.

8. Pickup day

On your pickup date, have all totes empty and nested inside each other so we can grab and go. For totes with attached (hinged) lids, fold the lid flaps open so the totes nest. For totes with separate lids, take the lids off and stack them together. Set the dollies alongside, all in a spot we can safely reach.

9. If the Equipment isn't ready on pickup day

• If we come for pickup and the Equipment isn't ready or we can't reach it, your rental is extended by 1 week and that week is charged to your card on file the same day, at your package's weekly rate. We'll text you to set a new pickup date.
• The same applies each week after that: your rental keeps renewing 1 week at a time, charged to your card on file, until we pick up the Equipment. You can end it any time by texting us that the Equipment is ready.
• We'll only treat Equipment as lost under section 7 if a weekly charge fails and we can't reach you within 14 days, or if you tell us it's lost.

10. Cancellations and date changes

• More than 48 hours before your delivery date: cancel for a full refund, or change your dates for free.
• Within 48 hours of your delivery date: a $25 cancellation fee applies, and the rest is refunded.
• If your address turns out to be outside our service area, we'll cancel and refund you in full.

11. Cleanliness

Every tote is cleaned and sanitized before each rental. Equipment is provided as is for moving and storage use, without other warranties.

12. Your belongings and safety

You're responsible for how you pack, lift, and move your belongings. To the extent the law allows, we aren't responsible for loss of or damage to your belongings, or for injuries from lifting or moving loaded Equipment, unless caused by our negligence. Our total responsibility under this agreement won't exceed the amount you paid for your rental.

13. General

Kentucky law governs this agreement. If any part of it can't be enforced, the rest still applies. This agreement, your booking confirmation, and our Terms of Service are the whole agreement between us. By checking the box at booking, you confirm you're at least 18 and that the information you gave us is accurate.
