Terms of Service

These terms cover your use of totesnky.com (the "Site") and booking with Totes NKY, a trade name of Yard Guard LLC ("we" or "us"). By using the Site or booking, you agree to these terms. Every rental is also covered by our Rental Agreement, which controls if the two ever conflict.

1. Our service

We rent plastic moving totes, lids, dollies, and hand trucks, and we deliver and pick them up. We don't provide packing or moving labor.

2. Bookings

• Bookings must be made at least 24 hours before the delivery date and are confirmed once payment goes through.
• We deliver to addresses in Northern Kentucky and Greater Cincinnati within about 60 miles of Florence, KY. Our address check estimates driving distance; if an address turns out to be outside our area, we'll cancel and refund in full.
• You agree to give accurate contact details, addresses, and stairs information.
• We may decline or cancel a booking for any lawful reason, with a full refund.

3. Prices and payment

Prices, delivery fees, and stairs fees are shown before you pay. Sales tax is added at checkout. Payments are handled by Stripe under its own terms. We may change prices at any time, but changes won't affect bookings that are already paid.

4. Cancellations and refunds

Cancellations and date changes follow the Rental Agreement: free more than 48 hours before delivery, and a $25 fee within 48 hours. Refunds go back to your original payment method, usually within 5 to 10 business days.

5. Text messages and emails

When you book, we'll send messages about your rental, such as confirmations, delivery and pickup reminders, and receipts, to the email and mobile number you provide. Message frequency varies by booking. Message and data rates may apply. Reply STOP to stop texts or HELP for help. We may also ask for a review after your rental. We don't send marketing texts unless you separately agree to them.

6. Using the Site

Don't misuse the Site, including trying to break into it, interfering with how it works, or submitting false bookings. The Site's content, logo, and photos belong to us and may not be copied for commercial use without our permission.

7. No warranties

The Site is provided as is. We work to keep it accurate and available but don't guarantee it will always be error-free or uninterrupted.

8. Limitation of liability

To the extent the law allows, we're not liable for indirect or consequential damages, and our total liability for any claim related to the Site or a rental won't exceed the amount you paid for that rental.

9. Governing law

These terms are governed by Kentucky law. Any dispute will be handled in the state or federal courts serving Boone County, Kentucky, unless the law requires otherwise.

10. Changes

We may update these terms. The date at the top shows the latest version. Changes apply to bookings made after they're posted.
